Treegram is available on iOS and Android platforms. For service access:

• Internet connection is required
• A compatible mobile device is required
• A valid account must be created

Treegram may, at any time and for any reason, providing reasonable notice for significant changes:

• Add new features or remove existing features
• Temporarily or permanently suspend the service

3. Account Creation and Security

3.1 Account Requirements

To create an account on Treegram:

• You must be at least 16 years old
• Use of the platform by persons under 16 is prohibited
• You must provide a valid email address
• You must provide accurate and current information

By using the application, you represent that you are at least 16 years old and have the legal capacity to accept these Terms of Service.

• Do not share your password with anyone
• Notify us immediately if you detect unauthorized access to your account
• You are responsible for all activities performed through your account

• Violent content or content promoting violence
• Sexual or obscene material
• Any material containing child abuse
• Terrorist propaganda
• Content promoting self-harm or suicide

5.3 Harassment and Bullying

• Harassing, threatening, or intimidating other users
• Cyberbullying
• Stalking behavior
• Unauthorized sharing of personal information (doxxing)

5.4 Spam and Abuse

• Sending spam content
• Creating fake accounts
• Using bots or automated systems
• Attempting to manipulate the platform
• Using fake identity to deceive other users

5.5 Technical Violations

• Attempting to bypass platform security measures
• Spreading viruses, malware, or harmful code
• Unauthorized data collection (scraping)
• Denial of service (DoS) attacks
• Unauthorized access to other users' accounts
• Reverse engineering the application

5.6 Commercial Restrictions

• Commercial use without written permission
• Sharing advertising or promotional content
• Selling or marketing user data

5.7 Rate Limiting

To prevent platform abuse, rate limits are applied to certain operations:

6. Content Policy

6.1 User Content

For all content you share on the platform ("User Content"):

• You remain the owner of the content
• You warrant that the content is legal

By sharing content, you grant Treegram the following rights:

• Perform technical operations necessary to provide the service
• Show content to other users (according to your privacy settings)

This license ends when you delete your content or close your account (except for backup copies).

Treegram reserves the right to review and remove content in the following situations:

• Content not complying with legal requirements
• Content reported by other users
• Content threatening platform security

All complaints are kept confidential. The identity of the reporting user is not disclosed to the content owner.

Treegram may store your content for backup purposes. While taking reasonable technical measures, it does not guarantee that your content will not be lost.

7. Intellectual Property Rights

7.1 Treegram's Rights

The following are the exclusive property of Treegram:

• Treegram name, logo, and brand
• Application design and user interface
• Software code and technical infrastructure
• Original content and graphics
• All intellectual property rights

7.2 Limited License

By accepting these terms, Treegram grants you:

• Use the application for personal, non-commercial purposes
• Install software necessary for service access on your device

7.3 Restrictions

Without explicit written permission:

• You may not use the Treegram brand or logo
• You may not copy or distribute the application

8. Family Tree Features

8.1 Creating Family Trees

When using the family tree feature:

• You become the owner of the family tree you create
• You are responsible for the accuracy of information you add to the tree
• You may only add other people's information with their permission
• You may add information about deceased family members

8.2 Invitations and Sharing

You can invite other users to your family tree. Owner and invited member permissions differ:

• Tree owner can remove guests at any time
• You are responsible for protecting the privacy of shared information

8.3 Third-Party Information

The user acknowledges that they have obtained the necessary consent for processing the data of living family members added to the platform, that all legal liability arising otherwise belongs to them, and agrees to indemnify and hold Treegram harmless from such claims.

8.4 Deleting Family Trees

When you delete a family tree:

• All person information in the tree is deleted
• Uploaded media files are deleted
• Guest access is revoked
• This action cannot be undone

9. Privacy

11. Limitation of Liability

11.1 App Stores

Treegram offers these terms in addition to the standard agreements provided by the store from which the application was downloaded (Apple App Store or Google Play Store). Treegram cannot be held responsible for store operator system failures or changes in store policies.

11.2 Service Provision

The Treegram service is provided "as is" and "as available". We make no express or implied warranty regarding:

• The service operating without interruption or error
• The service being fit for a particular purpose
• No data loss occurring
• Security breaches being prevented

11.3 Disclaimer of Liability

To the maximum extent permitted by law, Treegram is not liable for:

• Indirect, incidental, special, or punitive damages
• Loss of profit, data loss, or business interruption
• Actions of third parties
• Damages arising from user content
• Service interruptions or technical failures

11.4 Maximum Liability

In any case, Treegram's total liability shall not exceed the amount you paid for the service in the last 12 months (if any) or $100 (whichever is greater).

• Liabilities that cannot be legally limited
• Death or personal injury

12. Indemnification

You agree to indemnify and defend Treegram, its officers, employees, and representatives against any claims, damages, losses, and expenses arising from:

• Violation of applicable laws
• Infringement of third-party rights
• Your user content
• Your misuse of the service

12.2 Right to Defense

Treegram reserves the right to defend any claim with attorneys of its choice. In such cases, you must cooperate reasonably.

13. Account Suspension and Termination

13.1 Termination by User

You can close your account at any time:

13.2 Account Deletion Process

When you request account deletion, the following process applies:

When you cancel a deletion request and request again, the waiting period increases progressively:

This system is designed to prevent accidental or impulsive account deletions.

13.4 Data After Deletion

When your account is deleted:

• Content you own: Your posts, family trees you created, and media files you uploaded are permanently deleted
• Your guest contributions: People, comments, and photos you added to others' trees are anonymized (not deleted, displayed as "Deleted User")
• Your profile information: All your personal data is deleted

Anonymization is necessary to preserve the tree integrity of other users.

13.5 Termination by Treegram

Treegram may suspend or close your account in the following situations:

• Violation of these terms
• Illegal activities
• Harming other users
• Threatening platform security
• Prolonged account inactivity

13.6 Suspension Procedure

13.7 Consequences of Termination

When your account is closed:

• Your access to the service ends
• Your data is deleted according to our Privacy Policy
• Family trees you own are deleted
• Relevant provisions of these terms (intellectual property, liability limitations, etc.) remain in effect

13.8 Right to Appeal

To appeal an account suspension decision, you can apply to info@treegram.app within 30 days.

14. Changes

14.1 Updates to Terms

Treegram may update these Terms of Service from time to time. When changes are made:

• We will change the "Last Updated" date
• We will inform via email if necessary

14.2 Acceptance of Changes

Continuing to use the service after changes means you accept the updated terms. If you do not accept the changes, you may close your account.

14.3 Notice Period

At least 30 days advance notice will be provided for significant changes. Urgent security requirements may shorten this period.

15. Dispute Resolution

These Terms of Service are subject to and interpreted in accordance with the laws of the Republic of Turkey.

15.2 Jurisdiction

Istanbul Courts and Enforcement Offices have jurisdiction for resolving disputes arising from these terms.

15.3 Amicable Resolution

In case of any dispute, we encourage you to first try amicable resolution methods. You can submit your complaints to info@treegram.app.

15.4 Consumer Rights

Your legal rights as a consumer are not affected by these terms. Your right to apply to Consumer Arbitration Committees or Consumer Courts is reserved.

16. General Provisions

16.1 Entire Agreement

These Terms of Service and Privacy Policy constitute the entire agreement between you and Treegram and supersede all prior written or oral agreements.

16.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue to remain fully in effect.

16.3 Waiver

Treegram's failure to exercise or enforce any right in these terms does not constitute a waiver of that right.

16.4 Assignment

You may not transfer your rights or obligations under these terms without our written consent. Treegram may transfer these terms to any third party.

16.5 Force Majeure

Treegram is not liable for delays or unfulfilled obligations arising from events beyond its control (natural disasters, war, pandemic, government actions, internet outages, etc.).

16.6 Language

In case of conflict between different language versions of these terms, the Turkish version shall prevail.
